CharmKey Terms of Service

Welcome to CharmKey ("the Application"), operated by CharmKey ("Company," "we," "our," or "us"). By accessing or using the Application, you ("User," "you," or "your") agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must stop using the Application immediately.

1. Acceptance of Terms

By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Application.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Application. It is your responsibility to ensure compliance with all applicable laws and regulations in your jurisdiction. We reserve the right to terminate your access if we become aware that you do not meet these requirements.

3. Description of the Application

CharmKey is an AI-powered keyboard application that helps users generate and optimize chat responses. Key features include:

• AI-Generated Content: Provides suggestions to enhance your messaging experience.
• Customizable Labels: Allows configuration of custom labels for quick access to AI-generated content.
• Subscription Services: Offers various subscription plans with differing levels of access and features.

4. User Information and Privacy

We prioritize your privacy. By using the Application, you consent to the collection, use, and disclosure of your information as outlined in our Privacy Policy. Key points include:

• Data Collection: We collect information such as age, gender, usage data, and device information to personalize your experience and improve the Application.
• Data Usage: Collected data is used to enhance Application functionality, provide personalized content, and ensure compliance with legal obligations.
• Data Sharing: We may share your information with third-party service providers who assist in delivering the Application's services.

5. User Conduct

You agree to use the Application responsibly and refrain from actions that include but are not limited to:

6. Subscription Services and Billing

We offer subscription plans with enhanced features and unlimited access:

• One-Week Subscription
• One-Year Subscription

Billing and Payment:

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Payment Method: Payments are charged to your app store account at the confirmation of purchase.
• Cancellation: You can manage and cancel your subscription through your account settings in the app store.
• Price Changes: We reserve the right to modify subscription fees. Any changes will be communicated to you in advance and will apply upon your next subscription renewal.

7. Intellectual Property Rights

All content, features, and functionality of the Application, including but not limited to text, graphics, logos, and software, are the exclusive property of CharmKey and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Limitation of Liability

To the fullest extent permitted by law, CharmKey shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use or inability to use the Application.

9. Indemnification

You agree to indemnify, defend, and hold harmless CharmKey, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Application or violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you at least 30 days before the new terms take effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law provisions.
